Inhalte: Einführung in die ökonomische Anlyse des Rechts und den Nutzen diese Tools für die Forschung This course is the introduction to the economical analysis of law; also know as Law and Economics, and the usage of this tool in research. It is aimed to give the student a broad understanding of how to use microeconomic tools to quantify and value the outcome of the application of legal rules in both in the relationship between citizens and, their relationship with the state. Law and economics is mostly used to analyse, under price theory, the response given by the economy, and society in general, to the introduction of new legislation. This is a descriptive usage of the technique and it is the most validated usage. The second usage, and the most important one for this course, is in quantifying the relationship between the result of a legal body, and the desired standards based on society’s values and goals. Although this usage of the technique leads to more controversial results, it provides great results to discuss public policy. This course will dwell into civil (contracts, property rights and torts), constitutional, and criminal law matters.
Lernziele: Der Kurs soll dem Studierenden ein breite Verständnis dazu vermitteln, microökonomische Werkzeuge zu nutzen. um die Ergebnisse der Rechtsanwendung sowohl zwischen Bürgern und Staat als aauch zwischen Staat und Bürger zu quantifiizeren und zu bewerten.
Weitere Informationen zu den Prüfungsleistungen: Die Prüfungsleistung besteht in einer Anwendung des ökonomischen Analyse des Rechts in einem speziellen Feld des deutschen oder europäishcne Rechts. The exact terms of the examination will be discussed in the beginning of the course. However, the examination of this course could be a research project on the application of Law and Economics to a certain field of the German legal system. The students would be assigned from the beginning of the semester a topic, such as pollution, refugee crisis, criminality, country bailouts, etc., and would be expected to apply the content of the course to study her or his particular topic in the German current economical and legal system.
